Terms of Service: The Miner Island Company LLC

These Terms of Service govern your access to and use of theminerisland.com and all purchases made through it. By using this website or placing an order, you agree to be bound by these terms in full. If you do not agree, do not use this website or place an order.

1. Who we are

2. Eligibility

By using this website you confirm that:

• You are at least 18 years old
• You have the legal capacity to enter into binding agreements
• Your use of this website and any hardware purchased complies with the laws of your jurisdiction
• You are not located in a jurisdiction where the purchase, import, or operation of cryptocurrency mining hardware is prohibited

3. Products and availability

• All products are subject to availability at the time of order
• Product specifications, pricing, and availability may change without notice
• Images on the site are illustrative. Actual units may show minor packaging or hardware revision differences
• Products listed under the Pre-Orders category are not yet in stock and are subject to the Pre-Orders terms in Section 7

The Miner Island reserves the right to refuse or cancel any order at our discretion. If we cancel an order before fulfillment, any payment received will be refunded in full in the same cryptocurrency in which it was received.

4. Pricing and payments

All prices are listed in USD unless explicitly stated otherwise.

Crypto-only payments

The Miner Island accepts cryptocurrency payments only. We do not accept bank wire transfers, credit cards, PayPal, or any fiat payment method. All orders must be settled in cryptocurrency before fulfillment begins.

Accepted cryptocurrencies:

• Bitcoin (BTC): pay in BTC and save 3% on your entire order
• Ethereum (ETH)
• Tether (USDT): TRC20 and ERC20 networks
• USDC, Litecoin (LTC), Dogecoin (DOGE), Kaspa (KAS) and other major digital assets accepted at checkout

Payment finality

All cryptocurrency payments are final and irreversible once confirmed on the blockchain. By completing a payment, you acknowledge and accept that:

• Blockchain transactions cannot be reversed, recalled, or charged back
• We are not responsible for payments sent to incorrect wallet addresses
• We are not responsible for transaction errors caused by the buyer

For bulk orders, staged 50/50 payment and on-chain escrow options are available. Contact us before placing a bulk order to arrange this.

5. No refunds policy

All sales are final. The Miner Island does not issue refunds under any circumstances once a purchase is completed and payment is confirmed on the blockchain.

No refund will be issued for:

• Change of mind after payment
• Mining profitability concerns
• Market price movements after purchase
• Network difficulty changes
• Power cost changes at your facility
• Delays caused by customs, couriers, or logistics providers
• Buyer error in selecting hardware specifications
• Any other reason not covered by our Warranty Policy

If your unit arrives damaged or defective, you are covered under our 60-Day Replacement Warranty. A replacement unit will be dispatched, not a refund. See our Warranty Policy for full details.

The only exception to this no-refund policy is where The Miner Island cancels an order before fulfillment. In that case, the full payment amount is returned in the same cryptocurrency received.

6. Shipping and delivery

All orders ship from our Hong Kong warehouse. Dispatch occurs within 24 to 72 hours of payment confirmation.

DDP: Delivered Duty Paid

All orders are shipped DDP (Delivered Duty Paid) in accordance with Incoterms 2020. This means:

• All customs duties, import taxes, and clearance costs are paid by The Miner Island before delivery
• You will not be charged any additional customs fees upon receipt of your order
• Free DDP shipping is included on all orders over $5,000

Delivery times are estimates and are not guaranteed. The Miner Island is not liable for delays caused by couriers, customs authorities, or circumstances outside our control.

Risk of loss transfers to the buyer upon confirmed delivery to the shipping address provided at checkout.

7. Pre-orders

Products listed under the Pre-Orders category are hardware platforms that are not yet available for immediate dispatch. By placing a pre-order you acknowledge that:

• Your payment is collected at the time of order
• Dispatch will occur when the hardware becomes available from the manufacturer
• Estimated availability dates are provided in good faith and may change
• If we are unable to fulfill a pre-order, your full payment will be returned in the same cryptocurrency received

Pre-order payments are otherwise subject to the same no-refund policy as standard orders once the unit has shipped.

8. Bulk orders

Bulk orders (5 or more units) are subject to the following additional terms:

• Pricing is confirmed by our sales team before payment is made
• Staged 50/50 payment and on-chain escrow options are available on qualifying orders
• Orders of 100 or more units are subject to timestamped video inventory verification before payment
• Custom shipping arrangements are available and must be agreed in writing before order placement

9. Mining disclaimer

The Miner Island does not guarantee:

• Mining profitability of any specific unit or fleet
• Return on investment timelines
• Network hash rate, difficulty, or block reward rates
• Uptime or performance of third-party mining pools

Cryptocurrency mining is a technically complex activity with real and significant financial risk. Hardware efficiency, power cost, network difficulty, and coin price all affect profitability. Always conduct your own due diligence before purchasing mining hardware. The Miner Island is not responsible for unprofitable mining operations.

10. Intellectual property

All content on theminerisland.com, including text, logos, images, design elements, and product photography, is the property of The Miner Island Company LLC and may not be reproduced, republished, or distributed without prior written permission.

11. Prohibited use

You may not use this website to:

• Engage in fraudulent, unlawful, or deceptive activities
• Attempt to compromise website security or circumvent access controls
• Misrepresent your identity, payment information, or shipping details
• Conduct unauthorized commercial scraping, data harvesting, or resale aggregation
• Impersonate The Miner Island or its team members on any platform

12. Limitation of liability

To the maximum extent permitted by applicable law, The Miner Island shall not be liable for:

• Indirect, incidental, or consequential damages of any kind
• Loss of profits, revenue, or expected mining rewards
• Delays caused by third parties including couriers, customs authorities, payment processors, or blockchain networks
• Network outages, blockchain congestion, or mining pool failures
• Losses arising from your use or inability to use mining hardware

Our total liability to you in any circumstance shall not exceed the amount paid by you for the specific order giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless The Miner Island Company LLC, its officers, employees, and agents from any claims, losses, damages, or expenses, including legal fees, arising from your misuse of this website, your violation of these terms, or your violation of any applicable law.

14. Governing law

These Terms of Service are governed by the laws of the State of Maine, United States, without regard to its conflict of law principles. By using this website, you consent to the exclusive jurisdiction of the courts of the State of Maine for any disputes arising from these terms or your use of the site.

For EU and UK customers, nothing in these terms removes any rights you have under applicable consumer protection law in your jurisdiction.

15. Dispute resolution

We prefer to resolve disputes directly and quickly. If you have a concern, contact us first at sales@theminerisland.com or WhatsApp +1 617 300 8178 before pursuing any formal action. We respond to all dispute inquiries within 2 business days.

If a dispute cannot be resolved informally, it shall be subject to binding arbitration in the State of Maine under the rules of the American Arbitration Association, except where prohibited by the laws of your jurisdiction.

16. Changes to these terms

The Miner Island reserves the right to modify these Terms of Service at any time. Updates are posted on this page with a revised Last Updated date and take effect immediately upon posting. Continued use of the website after an update constitutes acceptance of the revised terms.
